Estas solicitudes de los usuarios constituyen las condiciones particulares a las que van asociadas las presentes Condiciones Generales que el usuario tiene que consultar con carácter previo a la contratación del servicio. Al usuario se le exponen a través del sitio web www.theclickproductionguide.com las presentes Condiciones Generales, a fin de que las lea, las imprima, archive y acepte, no pudiendo el usuario contratar el servicio sin que se haya producido la mencionada consulta y aceptación. usuario siempre dispondrá de estas Condiciones Generales en un lugar visible de la web.

Las presentes Condiciones Generales unidas a la solicitud de los servicios concretos realizada por el usuario implican la formalización del contrato de prestación de servicios entre theclick y el usuario que afirma haber leído, entendido y aceptado las presentes Condiciones Generales.

PRIMERA.- OBJETO DE LAS CONDICIONES GENERALES

Mediante las presentes Condiciones Generales, theclick, se compromete a prestar al Contratante los servicios que éste haya solicitado a través del sitio web www.theclickproductionguide.com a cambio de un precio determinado.

Mediante la contratación de los servicios disponibles en esta página web, el usuario declara que:

    A )    Que es una persona mayor de edad y con capacidad para contratar.
    B )    Que ha leído, comprendido y que acepta las presentesCondiciones Generales.

SEGUNDA.- LEGISLACION APLICABLE

Las presentes Condiciones Generales, están sujetas a lo dispuesto al Real Decreto Legislativo    1 /2007, de 16 de noviembre, por el que se aprueba el texto refundido de la Ley General por la Defensa de los Consumidores y Usuarios y otras leyes complementarias, al Real Decreto     1906 /1999, de 17 de diciembre de 1999, por el cual se regula la Contratación Telefónica o Electrónica con condiciones generales, a la Ley Orgánica 15/1999, de 13 de diciembre, de Protección de Datos de Carácter Personal y a la Ley 7/199, de 15 de enero de Ordenación del Comercio Minorista, a la Ley 34/2002 de 11 de Julio, de Servicios de la Información y de Comercio Electrónico.

TERCERA.- ALTERACION DE LAS CONDICIONES GENERALES

Theclick se reserva el derecho de modificar las presentes Condiciones Generales en cualquier momento, sin necesidad de comunicarlo previamente al usuario, que en cualquier caso es responsable de revisarlas como requisito previo a la contratación de cualquier servicio disponible a través de esta página web. En cualquier caso, se considerarán como válidas y aplicables las Condiciones Generales que estuvieran expuestas en la web en el momento que el usuario contrate los respectivos servicios.

CUARTA .- DERECHOS Y OBLICACIONES DE THECLICK

4.1    Prestación del servicio.- El pago del servicio proporcionará al Contratante el derecho de incluir publicidad de sus productos o servicios en el sitio web mediante la inclusión de sus logotipos, marcas y trabajos realizados para terceros en desarrollo de su actividad profesional en un espacio publicitario propiedad de theclick.

4.2.-    Modalidad del servicio.- El servicio se prestará en la modalidad que en cada caso se manifieste durante su contratación. Por modalidad debe entenderse básicamente el tiempo de contratación del servicio y el lugar y forma de ubicación de la publicidad del Contratante.

QUINTA.- DERECHOS Y OBLIGACIONES DEL USUARIO

Pago.- El Contratante se compromete a abonar el importe del servicio efectivamente solicitado en la cuantía y forma siguientes:

5.1.-    Formas de pago.- El importe de cada servicio será abonado en la forma y modo que sea acordado en cada caso.

SEXTO.- PROTECCION DE DATOS PERSONALES

6.1.-    Información al Contratante de la existencia de fichero y consentimiento para el tratamiento automatizado de los datos: En relación con los datos de carácter personal facilitados por el Contratante a los formularios que pueda haber en el sitio web, theclick cumple estrictamente la normativa vigente establecida en la Ley Orgánica 15/1999 de Protección de Datos de Carácter Personal y otras normas que la desarrollan e informa al Contratante que los datos referidos serán incluidos en un fichero para su tratamiento automatizado prestando el Contratante su consentimiento mediante la aceptación de estas Condiciones Generales al mencionado tratamiento.

6.2.- Finalidad del tratamiento: theclick recoge determinados datos personales que son introducidos por el contratante en el formulario para formalizar la contratación de los servicios. Theclick informa de que gestionará automatizadamente estos datos. Theclick tratará estos datos para la facturación del servicio, así como para el envio periódico de ofertas y de información comercial al usuario. En todo caso, los datos recogidos y tratados por theclick son los básicos para las finalidades señaladas anteriormente.

6.3.- Obligatoriedad de la introducción de los datos: Los campos en los cuales figure un asterisco* en los formularios existentes son aquellos que requieren una respuesta obligatoria y de no ser cubierto la consecuencia sería imposibilitado de remitir la consulta o de formalizar la contratación del servicio.

6.4.- Derechos de acceso, rectificación, cancelación y oposición: El usuario que introduzca sus datos personales a los diferentes formularios de alta, tendrá pleno derecho a ejercitar sus derechos de acceso, rectificación, cancelación y oposición en cualquier momento solicitándolo a info@theclickproductionguide.com , o solicitándolo por correo postal a theclick scp, con domicilio en calle Séneca 20, 3º1º 08006 Barcelona, incluyendo en ambos casos cópia del DNI u otro documento identificativo, del titular de los datos. 6.5.- Seguridad.- Theclick asegura la absoluta confidencialidad y privacidad de los datos personales recogidos y por ello se han adoptado medidas esenciales de seguridad para evitar la alteración, pérdida, tratamiento o acceso no autorizado y garantizar así su integridad y seguridad, especialmente las previstas en el Real Decreto 1720 / 2007, de 21 de diciembre, por el que se aprueba el Reglamento de desarrollo de la Ley Orgánica 15 / 1999, de 13 de diciembre, de protección de datos de carácter personal- Theclick no será responsable en ningún caso de las incidencias que puedan surgir en torno a los datos personales cuando se deriven de un ataque o acceso no autorizado a los sistemas de manera tal que sea imposible detectar por las medidas de seguridad implantadas o bien cuando se deba a una falta de diligencia del Contratante en relación a la guardia y custodia de sus claves de acceso o de sus propios datos personales.

6.6.- Veracidad de los datos.- El usuario es responsable de la veracidad de sus datos, comprometiéndose a no introducir datos falsos y a proceder a la modificación de los mismos si fuera necesario.

SÉPTIMA.- RESPONSABILIDAD

7.1.- Theclick en ningún caso será responsable de :

7.1.1.- Los errores e incidencias que pudieran producirse en las comunicaciones o transmisiones incompletas de manera que no se garantiza que los servicios del sitio web estén constantemente operativos

7.1.2.- De la producción de cualquier tipo de daño que el usuario o terceros pudieran ocasionar al sitio web.

7.2.- Theclick se reserva el derecho a suspender el acceso al sitio web sin previo aviso de forma discrecional y con carácter definitivo o temporal hasta el aseguramiento de la efectiva responsabilidad de los daños que pudieran producirse. Asimismo, theclick colaborará y notificará a la autoridad competente estas incidencias en el momento en que tenga conocimiento fehaciente que los daños ocasionados constituyan cualquier tipo de actividad ilícita.

OCTAVA.- PROPIEDAD INTELECTUAL E INDUSTRIAL.

En todo caso el usuario, es el único responsable ate los consumidores y usuarios así como ante las autoridades competentes de la legalidad de la información a la que la publicidad que inserte en su página web, pudiera dirigir.

NOVENA.- LEY APLICABLE Y JURISDICCION COMPETENTE.- Las presentes Condiciones Generales, se rigen por la legislación española. Para resolver cualquier controversia o conflicto que se derive de las presentes Condiciones Generales las partes declaran competentes a los tribunales de la ciudad de Barcelona.

DÉCIMA.- En caso de que cualquier cláusula de las presentes Condiciones Generales sea declarada nula, las otras cláusulas seguirán vigentes y se interpretarán teniendo en cuenta la voluntad de las partes y la finalidad de la misma de las presentes condiciones. Theclick podrá no ejercitar alguno de los derechos y facultades conferidos en este documento lo que no implicará en ningún caso la renuncia a los mismos salvo reconocimiento expreso por parte de theclick.

These applications by Users constitute the specific conditions associated with these General Conditions which the User has to consult prior to contracting the service. TWO.- GOVERNING LAW

These General Conditions are subject to Royal Legislative Decree 1 /2007, dated 16 November, approving the text redrafting the General Law for the Defence of Consumers and Users and other additional laws, to Royal Decree 1906 /1999, dated 17 December 1999, regulating the Contracting Telephone or Electronic Services with General Conditions, to Organic Law 15/1999, dated 13 December, on Personal Data Protection and Law 7/199, dated 15 January governing Small Scale Business, to Law 34/2002 dated 11 July, on Information and Electronic Business Services.

THREE.- ALTERATION TO THE GENERAL CONDITIONS

Theclick reserves the right to modify these General Conditions at any time, without the need to have previously communicated such change to the User, who in any case is responsible for checking them as a prior requirement to contracting any service available via this website. The General Conditions stated on the website at a time when the User contracts such services are considered to be valid and applicable under any circumstances.

FOUR .- RIGHTS AND OBLICATIONS OF THECLICK

4.1 Offering the Service.- Payment for the service shall give right for the Contractee to include advertising for its products or services on the website by including its logos, trademarks and work undertaken for third parties as part of its professional activity within the advertising space owned by Theclick.

4.2.- Means of providing the service.- The service shall be provided by the means stated for each case during the validity of the contract. The word “means” is understood to mean basically the period of time for the service under contract and the location and type of advertising location for the Contractee.

FIVE.- RIGHTS AND OBLIGATIONS OF THE USER

Payment.- The Contractee is obliged to pay the amount for the service which has been effectively requested in the following amounts and format:

5.1.- Forms of payment.- The amount of each service shall be paid for in the format and means agreed in each case.

SIX.- PROTECTION OF PERSONAL DATA

6.1.- Information for the Contractee of the existence of the consent file and application for the automatic processing of data: With reference to the personal data supplied by the Contractee on forms which may have been shown on the web site, Theclick shall strictly comply with existing regulations stated in Organic Law 15/1999 on Personal Data Protection and other laws arising from it. Theclick shall also inform the Contractee that the aforementioned data shall be included in a file for automated processing with the Contractee giving its consent for such processing by accepting these General Conditions.

6.2.- Purpose of a processing: Theclick collects predetermined personal data which are entered by the Contractee on the form in order to contract services. Theclick informs the User that it will automatically manage such data. Theclick shall process this data to invoice for the service and to periodically send commercial offers plus information to the User. In each case, the data collected and processed by Theclick is basic data for the purposes stated above.

6.3.- Obligation to enter data: The fields marked with an asterisk * on the current forms are fields requiring an obligatory response without which it shall not be possible to send the enquiry or to formalise the contract of service.

6.4.- Rights of access, rectification, cancellation and opposition: The User, when entering personal data on the different subscription forms, shall have full right to exercise their rights of access, rectification, cancellation and opposition at any time by requesting via info@theclickproductionguide.com, or by post to Theclick scp, with registered offices in calle Séneca 20, 3º1º 08006 Barcelona, including in both cases a copy of the National Identity Document or other identification document of the owner of the data. Theclick states that it shall be bound by the above and by the absolute confidentiality in collecting and processing the User’s personal data stating its commitment not to transfer such information to third parties in any case without the prior consent of the data's owners.

6.6.- Veracity of data.- The User is responsible for the veracity of its data and is obliged not to enter false information and to modify the same if necessary.

SEVEN.- RESPONSIBILITY

7.1.- Under no circumstances shall Theclick be responsible for:

7.1.1.- Errors or incidents which may arise from incomplete communication or transfer in as far as it does not guarantee that services on the website are constantly operational

7.1.2.- Any form of damage which the User or third parties may incur from using the web site.

7.2.- Theclick reserve the right to suspend access to the website without prior warning and at its own discretion definitively or temporarily until it has ensured responsibility for any damage arising therefrom. Furthermore, Theclick shall cooperate with and notify the competent authority about such incidents at the time when it has genuine knowledge that damage incurred constitutes any form of illegal activity.

EIGHT.- INTELLECTUAL AND INDUSTRIAL PROPERTY.

NINE.- APPLICABLE LAW AND COMPETENT JURISDICTION.- These General Conditions are governed by Spanish law. The parties state that they shall be subject to the competence of the courts of the city of Barcelona to resolve any dispute or conflict arising from these General Conditions.

TEN.- In the event that any clause in these General Conditions are declared null and void, the remaining clauses shall remain valid and shall be interpreted based on the will of the parties and the aims of these conditions. Theclick may choose not exercise any of the rights and powers conferred by this document. This in no way shall imply that such rights and powers have been renounced except where this has been expressly stated by Theclick.
